Welcome! These Terms of Service form an agreement between you and Playhouse Media LLC or, if you reside in the European Union, between you and Playhouse Media Trading Ltd. They cover the website available at SecretDesires.AI (the “Website”) and the SecretDesires.AI mobile application (the “App”). In these Terms, “secretdesires.ai,” “Company,” “we,” or “us” refers to Playhouse Media LLC or Playhouse Media Trading Ltd., as applicable based on where you reside, and “Services” refers to the Website, App, and any content, tools, features, and functionality offered through them.
These Terms govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights. By accessing or using the Services, you agree to these Terms. If you don't understand or agree to these Terms, please don't use the Services.
In these Terms, “you” and “your” refers to the user of the Services. SecretDesires.AI is not liable for any loss or damage arising from your failure to comply with these obligations.
SecretDesires.AI may establish general practices and limits concerning the use of the Services, including the maximum period of time that data or other content will be retained and the maximum storage space allotted. SecretDesires.AI is not responsible for the deletion or failure to store any data or content. Accounts inactive for an extended period may be terminated.

SecretDesires.AI maintains a zero-tolerance policy toward human trafficking, sex trafficking, and all forms of exploitation. The use of our Services to promote, facilitate, support, or engage in human trafficking or sex trafficking in any form is strictly prohibited.

SecretDesires.AI is committed to preventing its platform from being used to further trafficking or exploitation. We maintain internal controls to detect and respond to suspected trafficking activity, including content monitoring and review processes. We cooperate fully with law enforcement agencies investigating trafficking-related offenses and will provide information as required by law to assist in such investigations.
If you encounter any content or activity on the Services that you believe involves or promotes human trafficking, sex trafficking, or the exploitation of any individual, please report it immediately using any of the following methods:

SecretDesires.AI will acknowledge and investigate all complaints related to trafficking, exploitation, or illegal content. We are committed to resolving such complaints within five (5) business days of receipt. Any content determined to be illegal or in violation of this policy will be removed immediately upon identification, without waiting for the conclusion of the full investigation.
Violations of this Anti-Human Trafficking Policy will result in immediate suspension or termination of the offending user's account, removal of all associated content, reporting of the activity to the appropriate law enforcement authorities, and, where applicable, cooperation with ongoing investigations and legal proceedings.
SecretDesires.AI reserves the right to take any additional action it deems necessary to enforce this policy and protect the safety of individuals.
When you submit Content to the Services, you represent and warrant that you own all rights to that Content or have received all necessary permissions. You retain ownership of your Content but grant SecretDesires.AI a nonexclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual, irrevocable license to use the Content for any purpose related to the Services.
When you create an AI character (“Character”) using the Services, you own all rights to that Character. You also own any text, images, audio, or video generated by the Character (“Generations”). You grant SecretDesires.AI a license to use the Character and Generations as necessary to operate and promote the Services.
The Services may contain content protected by copyright, trademark, or other proprietary rights. You agree not to use such content except as expressly authorized. The SecretDesires.AI name and logos are trademarks of SecretDesires.AI, and nothing in these Terms grants you a license to use them without permission.
SecretDesires.AI is not liable for any third-party content or materials, including Characters created by third parties and any resulting Generations. You must evaluate and bear all risks associated with the use of any third-party content or Generations.
SecretDesires.AI respects the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been violated, notify SecretDesires.AI in accordance with the procedure below.

You agree to release, indemnify, and hold SecretDesires.AI and its affiliates, officers, employees, directors, and agents harmless from any losses, damages, or expenses arising out of your use of the Services.
Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. SecretDesires.AI expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SecretDesires.AI is not liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising from the use or inability to use the Services.
You agree that all disputes arising between you and SecretDesires.AI will be resolved exclusively through final and binding arbitration.
You and SecretDesires.AI agree that each may bring claims against the other only on an individual basis, not as part of a class action.

Arbitration will be conducted under JAMS' Streamlined Arbitration Rules and Procedures, with hearings in San Francisco, CA, unless otherwise agreed.
Payment of arbitration fees will be governed by JAMS Rules.
All aspects of the arbitration proceeding will be strictly confidential.
If any part of this Arbitration Agreement is found invalid, the remainder shall continue in effect.
SecretDesires.AI may suspend or terminate your account at any time for any reason, including inactivity or violation of these Terms. Termination does not affect SecretDesires.AI's rights to your Content.

These Terms constitute the entire agreement between you and SecretDesires.AI regarding the Services.
These Terms are governed by the laws of California. Any disputes not subject to arbitration will be resolved in Santa Clara County, California.
If any provision of these Terms is found invalid, the remainder will remain in full force and effect.
Failure to enforce any provision of these Terms does not constitute a waiver.
Any claim related to the Website or these Terms must be filed within one year.
You may not assign these Terms without written consent from SecretDesires.AI.

We may modify these Terms at any time. Changes will be posted on this page, and the date at the top will indicate the last revision. Changes become effective no earlier than 14 days after posting unless for legal reasons or new functions, in which case they are effective immediately.
